1. Introduction

Data Migration Tools is a service provided by Yin Yang Inc. d/b/a ClonePartner. We are committed to protecting the privacy of California residents in compliance with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).

2. Crucial Declaration: We Do Not Sell Your Data

The CCPA defines the “sale” of personal information very broadly. We explicitly declare that we do not sell, rent, release, disclose, disseminate, make available, transfer, or otherwise communicate your personal information or uploaded data to another business or a third party for monetary or other valuable consideration.

Because we do not sell your data, we are not required to provide a “Do Not Sell My Personal Information” opt-out link.

3. Our Role: “Service Provider”

When you use our utilities to convert or validate data files containing personal information:

  • You are the “Business”: You determine the purpose of the processing.
  • We are the “Service Provider”: We process this data solely on your behalf to perform the specific technical function (e.g., file conversion) you requested. We are contractually prohibited from retaining, using, or disclosing this data for any purpose other than performing the services specified in our Terms.

4. Your Rights Under CCPA

As a California resident, you have specific rights regarding your personal information. Here is how they apply to our specific “Zero-Retention” architecture:

  • Right to Know: You have the right to request details about the categories of personal information we collect. (See our Privacy Policy for this list).
  • Right to Delete: You have the right to request the deletion of your personal information. Note: Since our tools are designed to be ephemeral, your uploaded data is automatically deleted from our memory immediately after processing. We do not maintain archives of user-uploaded files.
  • Right to Non-Discrimination: We will not discriminate against you (e.g., by denying service or charging different rates) for exercising your CCPA rights.

5. Voluntary Compliance

While Yin Yang Inc. may not currently meet the strict revenue or volume thresholds that make CCPA compliance mandatory, we have chosen to voluntarily comply with these standards to ensure the highest level of trust for our users and enterprise partners.
