Data Migration Tools, operated by Yin Yang Inc. d/b/a ClonePartner, is fully committed to the principles of the General Data Protection Regulation (GDPR). We recognize that when you use our tools to convert or validate data, you may be processing the personal information of EU citizens.
2. Your Role vs. Our Role
Under the definitions of the GDPR, the relationship between you (the User) and us (the Tool Provider) is defined as follows:
- You are the Data Controller: You decide what data to upload, why it is being processed, and the legal basis for that processing. You are responsible for ensuring you have the right to process any personal data you upload.
- We are the Data Processor: We act strictly on your behalf. Our “processing” is limited to the technical act of converting, validating, or formatting the data you provide. We do not use the data for our own purposes (e.g., marketing or analytics).
3. Data Processing Specifics
Our unique architecture simplifies GDPR compliance:
- Data Minimization: We only process the specific file you upload for the specific action you request.
- Storage Limitation: As detailed in our Security Policy, our server-side processing is ephemeral. Data is processed in volatile memory and purged immediately upon completion. We do not retain personal data after the active session ends.
4. International Data Transfers
ClonePartner is a US-based company. If you are accessing this site from the European Economic Area (EEA), you acknowledge that your data may be processed on servers in the United States. To ensure this transfer is lawful, we rely on the Standard Contractual Clauses (SCCs) incorporated into our Data Processing Addendum.
5. Exercising Your Rights
Although we do not retain user data, we respect the rights of data subjects (Access, Rectification, Erasure, Portability).
- Since we do not store your data: The “Right to Erasure” (Right to be Forgotten) is effectively automated; your data is erased the moment your session ends.
